Humane Hosting, provides website hosting to people all around the world. As such we are required to protect each client and provide them with the best service possible. The following policies were created to make sure that our services remain of the highest quality. Please read with care before ordering and/or using Humane Hosting’s services.
All services provided by Humane Hosting are to be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any law are strictly prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. The account holder agrees to indemnify and hold harmless Humane Hosting from any claims resulting from the use of the service which damages the account holder or any other party.
Here is some examples of illegal as well as unacceptable contents which we do not allows. Please be aware that this list is no means complete!
In addition Humane Hosting does not permit the use and/or operation of proxy, Peer to Peer for File Sharing purposes, Bit Torrent and Point-to-Point, public and/or abusive IRC, torrents, Tor, Escrow, High Yield Investment Programs (HYIP), illegal gambling and lottery sites or services.
Humane Hosting will be the sole arbiter as to what constitutes a violation of this provision, and reserves the right to deactivate and remove any site at any time for any reason.
Humane Hosting will respond to all reports of infringement that are formatted in accordance with the Digital Millennium Copyright Act and any other applicable copyright laws. Notices of infringement that do not comply with this act will not be processed. We will act in accordance with the DMCA when handling infringement reports.
Please note that we limit hourly emailing from 50, 75, and 120 from our Startup plan to our Startup Supersized plan respectfully. As well as failures at 5%. If a higher sending rate is required please send us a presales ticket regarding this.
We agrees to furnish and make available resources that you paid for. Since all of these resources are reserved for your usages.
Humane Hosting will however closely monitor servers’ CPU, RAM, and other computing resources to assure the highest quality servicing to all of our clients. Should your account regularly use an unacceptable amount of these resource(s) and/or…
If you are unable to cooperate with us and we are forced to evict you then a most recent full Cpanel backup will be provided and your account deactivated. Refunds are fortified as a “fee” for the excessive usages/incorrect usage of your current account.
Please be advised that we only promises the efforts to conduct backups. Should we fail to restore your account we will provide some form of compensation for the inconveniences to you. This is will your SOLE remedy for this error should it happens.
Even then we highly recommend that our clients take their backups. In case that does happens on our end.
SPAMing, or the sending of unsolicited email, from a Humane Hosting’s server or using a return email address that is maintained on a Humane Hosting’s server is STRICTLY prohibited. Using SPAM to advertise a site hosted on Humane Hosting’s network also constitutes as a violation of this provision. Humane Hosting will be the sole arbiter as to what constitutes a violation of this provision. Sites found to be in violation of our SPAM policies will be immediately deactivated.
We also have the right to request any and/or all proofs that your service is complying to our requirements and/or CAN SPAM act. Here are our requirements in addition to CAN SPAM act…
Should an account fail such we have the right to end the account holder’s account for SPAM.
Please email our complaint department immediately should you suspect a violation of our SPAM policies.
You must have valid and current information on file with your domain name registrar for any domain hosted on Humane Hosting’s network.
At Humane Hosting, we always treat our customers with the respect they deserve. In return, we expect the similar treatment from you. If our staff feels that you are causing us harm in any forms (whether mentally and/or physically) and/or threatens to do so then we will be forced to terminate your services with us. This policy holds for business related threats/harms such as but not limited to network based attacks and so on as well.
Any attempts to undermine or cause harm to a Humane Hosting server or customer of Humane Hosting is strictly prohibited.
Humane Hosting will be the sole arbiter as to what constitutes a violation of this provision. Accounts found in violation of this provision will be subject to immediate account deactivation. Humane Hosting will turn all available information about abuse incidents, including customer contact data, over to the proper authorities and press charges.
To cancel an account, a cancellation request via Client Area (https://humanehosting.com/client) should be submitted.
It is your responsibility to ensure that all fees are paid no later than their due date.
As a customer of Humane Hosting, it is your responsibility to ensure that all billing information on file with Humane Hosting is accurate. You are solely responsible for any and all fees charged to your payment method by the issuer, bank, or financial institution including, but not limited to, membership, overdraft, insufficient funds and over the credit limit fees. Humane Hosting screens all orders for fraud. In certain cases, if your account is flagged for fraud, your order will not be processed. Humane Hosting has no liability for not providing Services, including third party services if your account fails the fraud screen.
Any account’s service(s) not paid in full by the end of the term will have such service(s) suspended. Failure to pay the outstanding invoice(s) within 3 days after this will results in your outstanding service(s) being terminated. ALL data will be removed from our systems in regard to these service(s). INCLUDING all/any backups.
Humane Hosting is not responsible for any damages or losses (including of any data) as a result of suspension or termination for non-payment of your account. In addition, Humane Hosting reserves the right to refuse to reactivate your Services until any and all outstanding invoices have been paid in full.
All of our services are able to be canceled and a pro rated refund will be provided on request to our support department. Provided that you did BOTH of these you are entitled to receive the unused time on it (days remaining).
Failure to fully comply with these terms is grounds for account suspension and/or deactivation. In addition Humane Hosting reserve the rights to report these violations to Fraud Record, the authorties, and/or etc. Any accounts and/or servers contained within Humane Hosting’s network must adhere to the above policies.
We reserve the right to remove any account without prior notice. Humane Hosting reserves the right to deactivate and remove any site hosted on our servers that contains any content that it deems in its sole discretion to be unacceptable, undesirable or contraindicated.
